Training Kit on Administrative Penalty
Disciplinary laws and regulations define the duties of work and its obligations towards the job, and likewise define the disciplinary penalties and sanctions imposed on the worker in case of a breach of their duties or departure from work rules and regulations.
A worker's commission of administrative violations during work gives the administration the right to take certain disciplinary measures to uncover the administrative violation committed, and to uncover its circumstances by referring the worker to administrative investigation, and to verify the perpetrator in order to impose the appropriate penalty on them. Administrative investigation has great, fundamental importance in reaching the truth in order to establish the relationship between the worker and the violation they committed. Since administrative investigation is a preliminary procedure, it entails serious consequences affecting the worker's career, and in order to ensure their stability and prevent the employee from being exposed to defamation, disturbance and anxiety, the legislator must surround the worker referred to investigation with legal guarantees that protect them from the administration's arbitrariness and injustice, and to ensure the soundness of the investigation and the attainment of the truth.
Administrative Investigation:
It is the inquiry into the accusation directed at the worker or employee, and confronting them with the accusation and the disciplinary violation, so that the truth can be reached by gathering correct information and all other truthful elements connected to the accusation.
