Training Kit on Litigation Procedures before the Courts of Appeal
Litigation before First-Instance Courts:
Since the disputes falling within the jurisdiction of first-instance courts vary and differ in their subject matter and importance, the legislator divided these courts into types, and on the basis of the difference in the type or subject matter of the case, the legislator determined the share of each of these courts. This type of jurisdiction is known as subject-matter jurisdiction.
Since courts of the same type are spread throughout the Kingdom to facilitate litigants' access to their rights, the legislator assigned each court a territorial jurisdiction, making each court competent over the disputes that occur within its district. This type of jurisdiction is known as territorial jurisdiction.
The Meaning of a Final Judgment in Saudi Law
It is the judgment that conclusively settles the dispute before the court in full, or settles part of it or a matter branching from it, and therefore cannot be reconsidered because it has been settled. A final judgment, when issued on the subject matter of the case or when issued on part of it, ends the entire subject matter of the dispute, such as a judgment awarding compensation that obliges the party against whom it was rendered to perform the obligation imposed on them by the judgment.
